Computing the correct amount of wages an injured worker earned prior to his/her injury so that the injured worker can be paid the correct amount of income after his/her accident.
DATE OF MAXIMUM MEDICAL IMPROVEMENT (MMI)
A point in time after which an injured worker has received adequate medical treatment and additional medical treatment or time is not expected to improve the injured workers’ medical condition. The date of MMI is very important in that it determines how long an injured worker is entitled to receive income benefits.
EXTENT-OF-INJURY ISSUES & DISPUTES
When the W/C insurance company refuses to pay for medical related to specific body parts and/or specific diagnoses (the insurance company is claiming the injury is a pre-existing medical condition or an ordinary disease of life)
Injuries which occurred after the accident, but which naturally flowed and developed from the original injury(s) and/or injuries sustained during the course of medical treatment of the compensable injury
Whether or not the injured worker has disability and is therefore entitled to weekly income benefits.
SUPPLEMENTAL INCOME BENEFITS
Additional income benefits an injured worker may be entitled to after certain conditions have been met.
IMPAIRMENT RATING (IR)
A number expressed in percentage points, occurs and is assigned on the day after the date of MMI, which also determines how long or how many weeks the injured worker will receive income benefits
Laws, practices, and procedures an injured worker needs to follow in order to receive continuing lifetime medical treatment for compensable injuries (the injuries sustained as a result the accident)
LIFETIME INCOME BENEFITS
Income benefits an injured worker may be entitled to for certain severe injuries as described in the Texas Workers’ Compensation rules and regulations
